Please read these Terms & Conditions carefully before using the Cogito website or enrolling in any of our courses. By accessing the site or completing an enrolment, you agree to be bound by these terms. If you do not agree, please do not use our services.
1. Definitions
- "Cogito", "we", "us", or "our" refers to Cogito, the operator of the online AI development school located at 88 Nimmanhaemin Road, Su Thep, Muang, Chiang Mai 50200, Thailand.
- "User", "you", or "your" refers to any individual who accesses the website or enrolls in a course.
- "Service" refers to the online courses, study materials, live question sessions, and all related resources provided by Cogito via cogiton.biz.
- "Content" refers to all course materials, videos, notebooks, datasets, texts, and any other material made available through the Service.
- "Agreement" refers to these Terms & Conditions together with our Privacy Policy and Cookie Policy.
- "Enrolment" refers to the completed registration and payment process that gives a user access to a specific course.
2. Acceptance of Terms
By accessing our website or completing an enrolment, you confirm that:
- You have read and understood these Terms & Conditions in full.
- You are at least 18 years of age, or have the consent of a parent or legal guardian.
- You have the legal capacity to enter into a binding agreement.
- Your use of the Service will comply with all applicable laws in your jurisdiction.
If you are accessing the Service on behalf of an organisation, you confirm that you have the authority to bind that organisation to these terms.
3. Service Description
Cogito provides online courses in programming and AI development, delivered via our website. Current courses are:
- Programming for AI: Starter Course – a six-week self-paced course covering programming and data fundamentals, with weekly question sessions and practice notebooks.
- Machine Learning in Practice – a ten-week course on data preparation, model building, and evaluation, with reviewed assignments and mentor feedback.
- AI Systems & Deployment Track – a fourteen-week track on building and deploying AI systems, structured around a portfolio project with mentor sessions and code reviews.
Course content is available online. We do not warrant uninterrupted access and may carry out maintenance or updates from time to time. Where disruption is foreseeable, we will give reasonable notice to enrolled students.
We reserve the right to modify course content to maintain accuracy and relevance. Material changes to an enrolled course will be communicated by email.
4. User Accounts
Upon enrolment you will receive account credentials to access course materials. You are responsible for:
- Keeping your login details confidential and not sharing them with anyone.
- All activity that occurs under your account.
- Notifying us promptly at [email protected] if you believe your account has been accessed without your permission.
Course access is for the enrolled individual only. Account sharing is not permitted and may result in access being withdrawn without a refund.
5. User Responsibilities
When using our Service, you agree to act honestly and responsibly. You may not:
- Copy, share, distribute, or republish course materials without written permission from Cogito.
- Use course materials for commercial training, resale, or public instruction purposes.
- Attempt to interfere with or disrupt the website or its underlying infrastructure.
- Impersonate Cogito, our staff, or any other user.
- Submit false or misleading information in any form or registration.
- Use the Service in any way that violates applicable Thai or international law.
We expect all learners to engage with course materials and fellow students with respect and honesty. Academic integrity is expected throughout your study.
6. Intellectual Property
All Content provided through the Service – including course videos, written materials, practice notebooks, datasets, and assessments – is the intellectual property of Cogito or its licensors and is protected under applicable copyright law.
Upon enrolment, Cogito grants you a personal, non-transferable, non-exclusive licence to access and use the course materials for your own private study during the access period. This licence does not permit:
- Redistribution or resale of any Content.
- Creating derivative works based on our Content for public or commercial use.
- Removing or altering any copyright notices within the materials.
Work you produce independently as part of a course (your own code, notebooks, or projects) remains your own. Cogito does not claim ownership over original work you create.
7. Payment Terms
Pricing
All course fees are displayed in Thai Baht (฿) inclusive of applicable taxes. Current fees are:
- Programming for AI: Starter Course – ฿3,800
- Machine Learning in Practice – ฿15,000
- AI Systems & Deployment Track – ฿33,000
Prices are subject to change. The fee applicable at the time you complete enrolment is the fee that applies to your course.
Refund Policy
If you wish to withdraw from a course before accessing any materials, please contact us within 7 days of enrolment to request a refund. We will review refund requests made within this period on a case-by-case basis.
Once course materials have been accessed, refunds are not available. This does not affect any statutory rights you may hold under applicable law.
8. Course-Specific Terms
Enrolment and Access
Course access begins when enrolment is confirmed and payment is received. Access duration varies by course and will be specified at the point of enrolment. We will make reasonable effort to extend access if technical issues on our end prevent you from completing a course within the stated period.
Completion and Records
Cogito issues a record of completion to students who finish the required work for a course. This record documents that study was completed; it is not a qualification, accreditation, or academic award.
Academic Integrity
Submitted assignments and projects must represent your own work. Misrepresenting the origin of submitted work may result in removal from the course without a refund.
9. Disclaimers
The Service is provided on an "as available" basis. While we work to keep course materials accurate and up to date, we do not warrant that the content is error-free, complete, or suitable for any particular purpose.
Cogito does not make promises about employment, salary, or specific outcomes resulting from completing a course. The skills and knowledge you develop depend on your own effort and application.
Nothing in these terms constitutes professional advice of any kind. Course content is educational material intended to develop technical skills.
10. Limitation of Liability
To the fullest extent permitted by Thai law, Cogito's total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid for the course to which the claim relates.
Cogito will not be liable for:
- Indirect, incidental, or consequential loss.
- Loss of data, income, or opportunity.
- Disruption caused by events outside our reasonable control, including infrastructure outages, natural events, or third-party service failures.
Nothing in these terms limits liability for fraud, personal injury caused by negligence, or any other liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold Cogito, its staff, and its content contributors harmless from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Service, or your violation of any third-party rights.
12. Termination
Either party may terminate the agreement at any time. If you wish to close your account, please contact us at [email protected].
Cogito may suspend or withdraw your access if you breach these Terms, without prior notice where the breach is serious. In less serious cases, we will give reasonable notice and an opportunity to address the issue.
Sections covering intellectual property, disclaimers, liability, and dispute resolution survive termination of the agreement.
13. Dispute Resolution
We aim to resolve concerns fairly and promptly. If you have a complaint, please contact us first at [email protected]. We will make a reasonable effort to address your concern within 14 business days.
These Terms are governed by the laws of the Kingdom of Thailand. Any dispute that cannot be resolved informally shall be referred to the courts of Chiang Mai, Thailand, which shall have non-exclusive jurisdiction.
Nothing in this clause prevents either party from seeking emergency injunctive relief in any appropriate court.
14. General Provisions
- Entire Agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Cogito regarding use of the Service.
- Severability. If any provision of these Terms is found to be unenforceable, that provision will be severed, and the remaining terms will continue in full effect.
- Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
- Assignment. You may not transfer your rights under these Terms to any other person. Cogito may transfer its rights and obligations where there is a change of ownership or business structure, without materially affecting your rights.
- Notices. Formal notices from Cogito will be sent to the email address you provide at enrolment. Notices to Cogito should be sent to [email protected].
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Service, applicable law, or business practice. When we make material changes, we will update the "Last Updated" date at the top of this page and notify enrolled students by email.
Continuing to use the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and contact us to discuss your options.
